Terms of Use

The short version
- Little Days Plus and Extended are auto-renewing subscriptions, billed by Apple to your Apple Account.
- Eligible new subscribers get a 3-day free trial of Plus. Cancel at least 24 hours before it ends and you will not be charged.
- Cancel any time in your Apple Account subscription settings. Deleting the app does not cancel.
- Your diary is yours. Without a subscription you can still read it, export it and delete it.
1. Agreement
Little Days is operated by Wermom Technologies Inc. (Toronto, Canada). These Terms of Use are an agreement between you and Wermom Technologies Inc. ("we", "us"). They apply when you download or use the Little Days iPhone app. If you do not agree, do not use the app.
The app is licensed to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These Terms add to the Standard EULA. If the two conflict on the license to use the app, the Standard EULA governs.

2. The app
Little Days is a diary: one page for each day, with text, photos, short videos and voice notes. Your private diary is stored on your iPhone and in your own iCloud, and you do not need an account to keep it. You are responsible for your device, your iCloud storage and your backups. You need an account to share a diary or collection, or to join one.
You must be at least 13 to create an account. We may change, add or remove features. If a change removes a paid feature you rely on, we will tell you in the app.
3. Subscriptions
Writing in Little Days requires a subscription: Little Days Plus, or Little Days Extended, which adds longer videos and voice notes and larger shared diaries. Both are auto-renewing subscriptions sold through Apple's App Store, with monthly and yearly options. The price, billing period and what is included are shown in the app before you confirm a purchase, in your local currency.
Free trial
New subscribers may be eligible for a 3-day free trial of Plus. Apple decides eligibility, and each Apple Account can receive the introductory offer once per subscription group. If you do not cancel at least 24 hours before the trial ends, your subscription begins automatically and you are charged the price shown when you started the trial. If you buy a subscription during a free trial, any unused part of the trial ends.
Payment and auto-renewal
- Payment is charged to your Apple Account when you confirm the purchase, or when the free trial ends.
- Your subscription renews automatically for the same period unless you turn off auto-renew at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period.
- If the price changes, Apple will notify you in advance as its rules require, and ask for your consent where required.
Cancel or manage
Cancel or change your subscription in your Apple Account settings: on iPhone, open Settings, tap your name, then Subscriptions. You can also go to apps.apple.com/account/subscriptions. When you cancel, you keep your plan until the end of the period you have paid for. Deleting the app does not cancel a subscription.
Without a subscription
If you never subscribe, or your subscription ends, Little Days becomes read-only for you: you can open, read, search and play everything, export your full archive, share a moment, and delete anything. You cannot add or edit moments, create shared diaries or collections, or invite people. We never delete your private diary because of billing. Shared diaries you own may close to other members after a grace period of 14 days and then remain as a private diary on your iPhone. Being a member of someone else's diary does not need a subscription, and people you invite join free.
Restore purchases
If you reinstall Little Days or use a new iPhone signed in to the same Apple Account, use Restore Purchases in the app's plan screen.
Refunds
Apple handles all billing and refunds under its own policies. To request a refund, go to reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves.
4. Your content
You own what you write, photograph, record and add. You give us only the permission we need to store it and show it to the people you choose: for a private diary that is none, because it does not reach us; for a shared diary it is to store, process and display the content to its members, and to deliver notifications. That permission ends when you remove the content or stop sharing, as described in the Privacy Policy.
You are responsible for what you add, including photos and recordings of other people. Only add what you have the right to share.
5. Shared diaries
The owner of a shared diary decides who can join and what each member can do, and can remove members. Everyone in a shared diary can see what the other members add to it, so share with people you trust. Members who leave can delete their own moments before they go; moments left behind stay in the diary.
You can report a moment, a person or a diary in the app. We review reports, and may remove content or suspend accounts that break these Terms. Do not add anything unlawful, abusive, sexually explicit, or that exploits or endangers a child.
6. Acceptable use
Do not use Little Days to break the law, to infringe anyone's rights, to harass anyone, or to interfere with the app, its website or the services it relies on. Do not try to reverse engineer the app except where the law allows it, and do not misuse the support form, for example by sending spam or automated submissions.
7. Disclaimers and liability
The app is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not promise the app will be error-free, or that data stored on your device or in your iCloud cannot be lost.
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data or profits. Our total liability for any claim about the app is limited to the amount you paid for Little Days in the 12 months before the claim.
Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
8. Ending these Terms
You can stop using Little Days at any time by deleting your account and the app. Remember to cancel any subscription separately. We may stop offering the app or suspend an account that breaks these Terms. If we stop offering the app, we will tell you in advance where possible, and you will be able to export your diary.
9. Changes
We may update these Terms. We will change the date at the top of this page, and tell you in the app about material changes. If you keep using Little Days after a change takes effect, the updated Terms apply.
10. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. The courts of Ontario have jurisdiction over any dispute about these Terms or the app. If you are a consumer, this does not take away the protection of mandatory laws of the country where you live, or your right to bring a claim there.
